These Terms & Conditions outline the legal framework under which Hostgenix Pvt. Ltd. (“Company”, “We”, “Us”) provides hosting, domain, and associated services to Clients (“You”, “Your”). By using Hostgenix.in or purchasing any hosting plan, you confirm acceptance of these terms in full. This section serves as a foundation, clarifying the contractual relationship and ensuring transparency in our operations.
The Agreement applies to all users, including individuals, businesses, and resellers. It governs website access, subscription to hosting services, and customer support. This overview establishes that Hostgenix functions as both a service provider and contractual partner, while the Client is responsible for abiding by the rules of engagement outlined here. The Agreement includes, but is not limited to, policies on Acceptable Use, Payments, Refunds, and Intellectual Property.
Hostgenix emphasizes the importance of clarity in interpreting these Terms. Words such as “Party” or “Parties” are interchangeable and collectively reference both the Client and the Company. Gendered language is non-exclusive, and singular forms also apply to plurals. The objective is to prevent ambiguity that could lead to disputes. Clients are strongly advised to carefully read the Terms before initiating any transaction, as ignorance of the clauses will not exempt them from obligations.
Acceptance of these Terms is confirmed once the Client registers on Hostgenix.in, places an order electronically, or otherwise begins using the Services. This forms a binding contract enforceable under applicable laws. The Agreement supersedes any prior verbal or written discussions and ensures that the official documentation governs the relationship. Failure to adhere to these Terms may result in account suspension, termination, or legal action.
Creating an account is mandatory for accessing Hostgenix Services. Clients must provide accurate details including name, billing address, and a valid email. False or misleading information may result in termination of Services without refund. Account credentials, including usernames and passwords, must be kept confidential. Hostgenix is not liable for unauthorized access due to weak passwords or negligence.
By registering, you confirm that you are at least 18 years old and legally capable of entering into binding contracts. Accounts found to be fraudulent, duplicated, or used for malicious purposes may be suspended immediately. Clients must update details regularly to ensure uninterrupted service delivery. Hostgenix may request identity verification documents to maintain security standards.
The Client is solely responsible for all activities under their account. If you suspect unauthorized access, you must inform Hostgenix immediately. Delay in reporting security issues may result in permanent data loss or liability for damages caused by misuse. Hostgenix retains the right to refuse service or close accounts at its discretion, especially if linked to policy violations.
Payments for all Services must be made in advance according to the plan selected (monthly, quarterly, annually). Hostgenix accepts multiple payment methods including credit card, debit card, PayPal, and UPI. Failure to pay invoices within the due date will result in suspension. Accounts overdue by more than 10 days may be terminated without notice.
Domain registrations and renewals are strictly non-refundable due to registrar policies. Hosting plans may include a 7-day Money Back Guarantee, applicable only if the request is submitted within the first 7 days of service activation. Refunds are not granted for misuse, violations, or partial usage of Services. Refund requests must be submitted in writing to billing@hostgenix.in with transaction details.
Chargebacks or disputed transactions initiated with banks or payment processors will result in immediate suspension. Clients must resolve billing issues directly with Hostgenix before initiating disputes. Reconnection after suspension due to chargebacks may attract administrative fees. All payments made after the guarantee period are non-refundable.
Clients agree to use Hostgenix Services responsibly and in compliance with applicable laws. The Acceptable Use Policy (AUP) strictly prohibits hosting illegal content, distributing malware, launching DDoS attacks, engaging in phishing, or spamming. Activities such as hosting pirated movies, copyrighted music, or hacking tools are forbidden.
Use of free TLD domains (.tk, .ml, .ga, .cf, .gq) for malicious purposes is banned. Clients may not run resource-heavy scripts, background processes, or mass-mailing services on shared hosting plans. Violations of these rules will lead to immediate suspension without refund. Hostgenix may investigate, monitor, and share information with law enforcement in case of misuse.
Clients are responsible for content uploaded on their accounts. Hostgenix does not monitor client data actively but reserves the right to remove content deemed harmful or illegal. Abuse of Services may attract civil or criminal liability in addition to account termination.
Hostgenix provides a 99.9% uptime guarantee on its hosting infrastructure, excluding scheduled maintenance or external issues beyond control. Uptime is measured on a monthly basis, and service credits may be applied in case of significant downtime caused by Hostgenix infrastructure.
Scheduled maintenance will be communicated 12–24 hours in advance via email or dashboard alerts. Emergency maintenance may be carried out without notice if required for security or network stability. Clients acknowledge that 100% uptime is not possible due to hardware, network, or software dependencies.
Support is available 24/7 through tickets, live chat, email, and WhatsApp. Clients must provide accurate details while submitting support requests. Abuse, harassment, or use of offensive language towards support staff will not be tolerated and may result in account suspension. Premium support for advanced configurations may be available at additional costs.
All intellectual property on Hostgenix.in—including designs, logos, text, graphics, code, and software—is owned by Hostgenix Pvt. Ltd. or licensed third parties. Clients may not copy, distribute, reproduce, or use such materials without written consent. Unauthorized use may result in civil or criminal penalties.
Content uploaded by Clients remains their property, provided it does not violate laws or Hostgenix policies. By hosting with Hostgenix, Clients grant the Company a limited license to store, transmit, and back up their content solely for service delivery. Hostgenix does not claim ownership of Client-generated content.
Hostgenix will not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities. Our liability is strictly limited to the amount paid by the Client in the 12 months preceding the claim. This limitation applies to all claims, whether contractual, tort, or statutory.
Clients acknowledge that hosting inherently involves risks such as data loss, downtime, or third-party attacks. Hostgenix strongly recommends Clients maintain independent backups. The Company shall not be held responsible for damages caused by client negligence, third-party software, or external providers.
Hostgenix reserves the right to modify these Terms & Conditions at any time. Updates will be posted on Hostgenix.in, and Clients are expected to review them regularly. Material changes may also be communicated via email. Continued use of Services constitutes acceptance of revised Terms.
If a Client disagrees with updates, they must discontinue Services and formally request cancellation. Failure to do so implies consent. Hostgenix is not responsible if Clients fail to review updated Terms.
These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be resolved in courts located in Ahmedabad, Gujarat. Both Parties agree to attempt resolution through negotiation before seeking legal remedies.
If any provision of these Terms is found invalid, the remaining clauses remain enforceable. This Agreement represents the entire contract between Hostgenix and the Client, superseding any previous agreements or communications.
